1. Services

TDTech LLC provides IT consulting, custom web application development, database management, and SMS communication services for businesses. Our services include but are not limited to:

• Automated SMS appointment reminders and notifications

2. SMS Messaging Terms

By opting in to receive SMS messages from TDTech LLC or from applications we build and operate on behalf of our clients, you agree to the following:

• Consent: You provide express written consent to receive SMS/MMS messages by opting in through our website, web applications, or by providing your phone number and agreeing to receive messages.
• Message Types: Messages may include appointment reminders, service notifications, account updates, and related communications.
• Message Frequency: Message frequency varies. You may receive up to 5 messages per month depending on your service usage.
• Costs: Message and data rates may apply. TDTech LLC does not charge for SMS messages, but your carrier may apply standard messaging fees.
• Opt-Out: You can opt out at any time by replying STOP to any message. You will receive a confirmation and no further messages will be sent.

• Carrier Liability: Carriers (AT&T, Verizon, T-Mobile, etc.) are not liable for delayed or undelivered messages.

No mobile opt-in information or consent data will be shared with third parties for marketing or promotional purposes.

3. User Responsibilities

You agree to:

• Provide accurate information when using our services
• Maintain the confidentiality of any account credentials provided to you
• Use our services only for lawful purposes
• Not attempt to interfere with or disrupt our services or systems

4. Intellectual Property

Unless otherwise specified in a separate service agreement, TDTech LLC retains ownership of all proprietary tools, frameworks, and methodologies used to deliver services. Custom work product created specifically for you under a service agreement is owned by you upon full payment.

5. Limitation of Liability

To the maximum extent permitted by law, TDTech LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the fees paid by you in the twelve (12) months preceding the claim.

6. Disclaimer of Warranties

Our services are provided "as is" and "as available." We make no warranties, express or implied, regarding the operation or availability of our services, including any warranties of merchantability, fitness for a particular purpose, or non-infringement.

7. Indemnification

You agree to indemnify and hold harmless TDTech LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or violation of these Terms.

8. Termination

Either party may terminate the service relationship at any time with written notice. Upon termination, you remain responsible for any outstanding fees. Provisions that by their nature should survive termination will remain in effect.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the state in which TDTech LLC operates, without regard to conflict of law principles.

10. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with a revised effective date. Your continued use of our services constitutes acceptance of the modified Terms.
